Iowa Caps Liability Against Trucking Companies

A new Iowa law limits noneconomic damages in lawsuits stemming from crashes with heavy-duty trucks. 

The measure, which sets a $5 million cap on non-economic damages, was signed into law May 12 by Iowa Gov. Kim Reynolds. Specifically, “noneconomic damages” refers to pain, suffering and loss of chance, among other things. 

There are some exceptions, including if the driver was operating under the influence, going 15 mph over the speed limit or using a cell phone during the crash. 

The $5 million threshold will be adjusted by the Iowa secretary of state for inflation on Jan. 1, 2028, the bill reads, as well as every two years after that.
