FMCSA Finalizes Crash Determination Program Update

Federal regulators have decided to expand the Crash Preventability Determination Program (CPDP). 

The Federal Motor Carrier Safety Administration (FMCSA) is adding four new crash types to the existing 16 in the CPDP, according to a Dec. 4 Federal Register notice. This is to keep unpreventable crash data from skewing safety statistics. 

The four new types are: 

  1. A commercial motor vehicle (CMV) is hit by a motorist traveling in the same direction 

  1. A CMV is struck by a motorist coming out of a private driveway or parking lot 

  1. A CMV is struck by a motorist who lost control of the vehicle 

  1. Any other type of CMV-involved crash where a video shows the sequence of events 

The expansion was originally proposed in April 2023. FMCSA noted that proposal received 60 received unique comments that “largely supported the proposed changes.” 

The agency said it doesn’t yet have a date when it will begin accepting submissions pertaining to the new crash types, but that information will be published on its website.
