Comment Period Extended for Worker Classification Plan

Those wishing to comment on the newly proposed worker classification rules will now have some extra time. 

The Labor Department has extended the comment period on the proposal — which revamps the process for classifying workers as either employees or contractors — from Nov. 28 to Dec. 13, according to a notice in the Federal Register. 

Since the original notice was published on Oct. 13, nearly 3,000 comments have been submitted. 

The agency’s proposed rule would rescind the current standard for determining a worker’s status — an “economic reality test” involving five factors — with a new test that looks at the totality of a worker’s relationship with an employer.
