Calif. Agency Wants ELDs for Intrastate Trucks

While California’s in-state commercial drivers don’t currently have to use an electronic logging device (ELD), that could soon change. 

The California Highway Patrol (CHP) wants to require ELDs for commercial vehicles traveling intrastate, according to a proposed regulation sent to the state’s office of administrative law. 

“The use of ELDs will enhance commercial vehicle safety by improving compliance with the applicable hours-of-service (HOS) rules and reducing the overall paperwork burden for both motor carriers and drivers,” reads the notice. 

The agency noted this proposal is meant to bring the state’s laws into compliance with federal law. 

An ELD would not be required if the driver completes a record-of-duty status “on not more than 8 days within any 30-day period” or is driving a vehicle manufactured before model year 2000. 

There would also be an exemption for drivers operating with a 100-mile air radius of the location they normally report to for work. 

The proposal is currently open for public comment.
